Their three children were born here and during this period, Samuel and Alice both performed regularly at the "Old Opera House" on the second floor of Brighton's Town Hall. The hall was built ibn 1885 and demolished by a tornado on July 13th, 1973. Their daughter Ruby (1904) performed in these plays right from when she was a young girl. Maurice Cheer (1891) also performed and got the nickname "Rube" from one of the characters he portrayed. Mr. Cheer also directed many of the plays performed at this time and Alice, a gifted singer, was also pianist for other acts and performances at the Opera House. Sam Cheer was bailiff and mail courier in the '20s and '30s. Their son Ralph (1893) was nicknamed Dan from a performance. As a young man, he operated an ice cream parlour in the Proctor Block, on the easterly north side of Main Street. This is now the brick wall just west of the restored facade of the old Standard and CIBC bank, and is part of the Sobeys parking lot. This block, after many renovations over the years, was destroyed by fire in 1980. Ralph was also employed by Grant Quick at Presqu'ile Pavilion in the 1920s and again in the late 1940s. During this period he also owned a farm east of the present public school at Spring Valley on County Road 26. The family lived there until they "moved to town" in 1948. Their farm was purchased by Peter and Jessie Kulaska, newly arrived from Europe and is now owned by Peter and Jessie's one daughter, Lucille and son-in-law, Tom Coyne, who are chicken producers. Maurice Cheer, an electrician by trade, worked locally; he rewired the Cooey plant at one time and was employed at General Motors as an electrical maintenance man. Note: Subsequent emails provide documents from the Interior Department re Civil War Pension allocations re this family. The question came down to whether Lucinda's first marriage was dissolved legally or not. Divorces were much easier to get in the US so it is assumed Timothy Packard got a divorce from Lucinda in New York State before he married Sarah. Pensions were allocated accordingly to Sarah and her kids. It looks like Lucinda and Henry may have been persuing pension benefits based on her first marriage and they did the marriage in 1881 to re-confirm that theirs was a legitimate marriage.
Note: Andrew Daft sent info re first marriage of Lucinda in 1852 in Picton (when she was 14!) to Tomothy Eastman Packard. That marriage lasted only a year, one child, Alberta, was born, and they split. Both married again. This helps but does not address the very odd situation of a marriage registration in 1881 for a marriage that happened in 1857 or so. I checked again and there absolutley nothing in the marriage registation that suggests anything unusual; their ages are even shown properly at 45 for him and 41 for her. It says he is a bachelor and she a widow - which would of course be the only wrong thing in the document.

Note: Subsequent emails provide documents from the Interior Department re Civil War Pension allocations re this family. The question came down to whether Lucinda's first marriage was dissolved legally or not. Divorces were much easier to get in the US so it is assumed Timothy Packard got a divorce from Lucinda in New York State before he married Sarah. Pensions were allocated accordingly to Sarah and her kids. It looks like Lucinda and Henry may have been persuing pension benefits based on her first marriage and they did the marriage in 1881 to re-confirm that theirs was a legitimate marriage.
Note: Andrew Daft sent info re first marriage of Lucinda in 1852 in Picton (when she was 14!) to Tomothy Eastman Packard. That marriage lasted only a year, one child, Alberta, was born, and they split. Both married again. This helps but does not address the very odd situation of a marriage registration in 1881 for a marriage that happened in 1857 or so. I checked again and there absolutley nothing in the marriage registation that suggests anything unusual; their ages are even shown properly at 45 for him and 41 for her. It says he is a bachelor and she a widow - which would of course be the only wrong thing in the document.
Note: It is also clear that documents re her children show that Lucinda is the mother of Samuel and Elgin etc.^1,13,14 As of 1 November 1859,her married name was Cheer.¹ Lucinda Victoria Davidson "Lucinda Victoria Davidson and Timothy Eastman Packard were married July 19, 1852, at Picton, Ontario, Canada. In November 1854, Packard deserted his wife and came to the United States. On August 31, 1855, he married Sarah Whitman at Brownville, Jefferson County, New York, and lived with her as his wife until he was drafted in the service of the United States in Wisconsin in 1864. He died in the service January 20, 1865, leaving one child, Alberta V. H. Packard, by his first wife, Lucinda V., and four children, Sarah A., William L., David E., and Timothy E. Packard, by his second wife Sarah. Pension was allowed the last named four children from January 21, 1865. William L. died April 1, 1873, and the others attained the age of 16 years, as follows: Sarah A., July 12, 1873, David E., November 12, 1877, Timothy E., October 13, 1880. Lucinda was remarried to Henry Cheer, November 1, 1859. The first question is, which of the two widow claimants was the legal widow of the soldier. There is no question of the legality of the marriage of the soldier to Lucinda in 1852. If he was not divorced from her when she married Henry Cheer, her marriage to Cheer was illegal, and she was the soldier's widow at the time of his death. For the same reason, the soldier's marriage to Sarah woudl be illegal, and their children illegitimate. But this conclusion does not follow from the facts. of the case. It is not proved that the soldier did not procure a divorce from his first wife when he came to the United States and married Sarah. Divorces in Canada are difficult, but are not difficult in the United States. He might easily have procured a divorce in any county in the state of New York or in any other state, where he might have resided. It is impossible, after the lapse of 40 years, and 30 years after the death of the soldier, to prove that he did not obtain such divorce. The legal presumption is that his marriage to Lucinda had been legally dissolved when he married Sarah, and this presumption must obtain in the absence of proof to the contrary. To hold otherwise "involves declaring void two marriages consumated according to law - declaring that four respectable persons were guilty of adulterous cohabitation - declaring that two sets of children are illegitimate, and declaring that two persons were guilty of felony and should have been sent to States prison." ..... Accepting, as I think this Bureau is bound to do upon the authorities cited, the legal presumption that the prior marriage of the soldier to Lucinda was legally dissolved before the second marriage of either of the parties, it follows that these second marriages were respectively legal marriages, and consequently that Lucinda V. Cheer, formerly Packard, was legally married to Henry Cheer in 1859, and has no title to pension as the widow of the soldier, and that Sarah Packard was the soldier's legal widow, and her children the legitimate issue of the soldier. Upon this basis the only defects in previous adjudications are that the minor claimant, Alberta V., the legitimate child of the soldier by his first wife, was entitled to pro rate with the children by the second wife, after the remarriage of the widow Octiber 24, 1866, until this minor attained the age of 16 on April 17, 1869, and that the widow, Sarah, was entitled to pension from the date of the soldier's death in 1865, until her remarriage, October 24, 1866, and the children pensioned by Certificate No. 138,086, were not entitled to pension for the period between Janaury 21, 1865 and October 24, 1866. The claim of Roswell S. Packard, as dependent father of the soldier, was properly rejected for the reason that the soldier left surviving him a widow and minor children." The water cascaded down the narrrow valley, following the creek to the north-east, all the way to Cole Creek and eventually the Trent River. Lewis Shearer's saw mill in the valley north of Hilton was destroyed, killing Mr. Shearer and a helper, Jacob Herrington. This event is known in local parlance as "The Breakaway". The Stephens brothers, Alva and Daniel, had recently obtained parts of the south half of lot 5 from their father Richard, so, all of a sudden, their lake was gone. They sold to John Philp soon after.
