Maurice Cheer (1891) also performed and got the nickname "Rube" from one of the characters he portrayed. Note: Subsequent emails provide documents from the Interior Department re Civil War Pension allocations re this family. The question came down to whether Lucinda's first marriage was dissolved legally or not. Divorces were much easier to get in the US so it is assumed Timothy Packard got a divorce from Lucinda in New York State before he married Sarah. Pensions were allocated accordingly to Sarah and her kids. It looks like Lucinda and Henry may have been persuing pension benefits based on her first marriage and they did the marriage in 1881 to re-confirm that theirs was a legitimate marriage.
Note: Andrew Daft sent info re first marriage of Lucinda in 1852 in Picton (when she was 14!) to Tomothy Eastman Packard. That marriage lasted only a year, one child, Alberta, was born, and they split. Both married again. This helps but does not address the very odd situation of a marriage registration in 1881 for a marriage that happened in 1857 or so. I checked again and there absolutley nothing in the marriage registation that suggests anything unusual; their ages are even shown properly at 45 for him and 41 for her. It says he is a bachelor and she a widow - which would of course be the only wrong thing in the document.

Note: Subsequent emails provide documents from the Interior Department re Civil War Pension allocations re this family. The question came down to whether Lucinda's first marriage was dissolved legally or not. Divorces were much easier to get in the US so it is assumed Timothy Packard got a divorce from Lucinda in New York State before he married Sarah. Pensions were allocated accordingly to Sarah and her kids. It looks like Lucinda and Henry may have been persuing pension benefits based on her first marriage and they did the marriage in 1881 to re-confirm that theirs was a legitimate marriage.
Note: Andrew Daft sent info re first marriage of Lucinda in 1852 in Picton (when she was 14!) to Tomothy Eastman Packard. That marriage lasted only a year, one child, Alberta, was born, and they split. Both married again. This helps but does not address the very odd situation of a marriage registration in 1881 for a marriage that happened in 1857 or so. I checked again and there absolutley nothing in the marriage registation that suggests anything unusual; their ages are even shown properly at 45 for him and 41 for her. It says he is a bachelor and she a widow - which would of course be the only wrong thing in the document.

For the same reason, the soldier's marriage to Sarah woudl be illegal, and their children illegitimate. But this conclusion does not follow from the facts. of the case. It is not proved that the soldier did not procure a divorce from his first wife when he came to the United States and married Sarah. Divorces in Canada are difficult, but are not difficult in the United States. He might easily have procured a divorce in any county in the state of New York or in any other state, where he might have resided. It is impossible, after the lapse of 40 years, and 30 years after the death of the soldier, to prove that he did not obtain such divorce. The legal presumption is that his marriage to Lucinda had been legally dissolved when he married Sarah, and this presumption must obtain in the absence of proof to the contrary. To hold otherwise "involves declaring void two marriages consumated according to law - declaring that four respectable persons were guilty of adulterous cohabitation - declaring that two sets of children are illegitimate, and declaring that two persons were guilty of felony and should have been sent to States prison." ..... Accepting, as I think this Bureau is bound to do upon the authorities cited, the legal presumption that the prior marriage of the soldier to Lucinda was legally dissolved before the second marriage of either of the parties, it follows that these second marriages were respectively legal marriages, and consequently that Lucinda V. Cheer, formerly Packard, was legally married to Henry Cheer in 1859, and has no title to pension as the widow of the soldier, and that Sarah Packard was the soldier's legal widow, and her children the legitimate issue of the soldier.
