Is this right??2 - Note*: 19 July 1852; Picton, Prince Edward Co., Canada West; "Lucinda Victoria Davidson and Timothy Eastman Packard were married July 19, 1852, at Picton, Ontario, Canada. In November 1854, Packard deserted his wife and came to the United States. On August 31, 1855, he married Sarah Whitman at Brownville, Jefferson County, New York, and lived with her as his wife until he was drafted in the service of the United States in Wisconsin in 1864. He died in the service January 20, 1865, leaving one child, Alberta V. H. Packard, by his first wife, Lucinda V., and four children, Sarah A., William L., David E., and Timothy E. Packard, by his second wife Sarah. Pension was allowed the last named four children from January 21, 1865. William L. died April 1, 1873, and the others attained the age of 16 years, as follows: Sarah A., July 12, 1873, David E., November 12, 1877, Timothy E., October 13, 1880. Lucinda was remarried to Henry Cheer, November 1, 1859. The first question is, which of the two widow claimants was the legal widow of the soldier. There is no question of the legality of the marriage of the soldier to Lucinda in 1852. If he was not divorced from her when she married Henry Cheer, her marriage to Cheer was illegal, and she was the soldier's widow at the time of his death. For the same reason, the soldier's marriage to Sarah woudl be illegal, and their children illegitimate. But this conclusion does not follow from the facts. of the case. It is not proved that the soldier did not procure a divorce from his first wife when he came to the United States and married Sarah. Divorces in Canada are difficult, but are not difficult in the United States. He might easily have procured a divorce in any county in the state of New York or in any other state, where he might have resided. It is impossible, after the lapse of 40 years, and 30 years after the death of the soldier, to prove that he did not obtain such divorce. The legal presumption is that hsi marriage to Lucinda had been legally dissolved when he married Sarah, and this presumtion must obtain in the absence of proof to the contrary. To hold otherwise "involves declaring void two marriages consumated according to law - declaring that four respectable persons were guilty of adulterous cohabitation - declaring that two sets of children are illegitimate, and declaring that two persons were guilty of felony and should have been sent to Stats prison." ..... Accepting, as I think this Bureau is bound to do upon the authorities cited, the legal presumption that the prior marriage of the soldier to Lucinda was legally dissolved before the second marriage of either of the parties, it follows that these second marriages were respectively legal marriages, and consequently that Lucinda V. Cheer, formerly Packard, was legally married to Henry Cheer in 1859, and has no title to pension as the widow of the soldier, and that Sarah Packard was the soldier's legal widow, and her children the legitimate issue of the soldier. Upon this basis the only defects in previous adjudications are that the minor claimant, Alberta V., the legitimate child of the soldier by his first wife, was entitled to pro rate with the children by the second wife, after the remarriage of the widow Octiber 24, 1866, until this minor attained the age of 16 on April 17, 1869, and that the widow, Sarah, was entitled to pension from the date of the soldier's death in 1865, until her remarriage, October 24, 1866, and the children pensioned by Certificate No. 138,086, were not entitled to pension for the period between Janaury 21, 1865 and October 24, 1866. The claim of Roswell S. Packard, as dependent father of the soldier, was properly rejected for the reason that the soldier left surviving him a widow and minor children." Genevieve was married to Carman R. Wessels of Brockport New York. In actual fact, he was my Step-Uncle. Carman had a half-brother by the name of Wyatt G. Raleigh. I didn't know if this is news to you, or not but, Carman was born Carman Raleigh, then soon after adopted by Mattie and Norris Wessels. This adoption may have taken place so fast that he was never a Raleigh. There were no Birth Certificates at that time. To put things in perspective, my father Wyatt was born about 1906, and Carman was born in 1909.The same Mother, Pearl Raleigh (unwed). Mattie Wessels was Mattie Raleigh, Pearl's sister, before she married Norris. She and Norris were childless; they took Carman. As I said, Wyatt was my dad, and knew Carman and Genevieve. I had been to their house in Lockport a few times when I was young. I do remember that Aunt Gene (I thought it was Jean) was a School Teacher, and Carman looked a lot like my father.
