The two men were working in the mills at the time. This is a well known story in the area. That your petitioner has suffered great inconvenience not only from the loss of ground occupied by said road but also from having the remaining part open to commons. Your petitioner therefore prays that you will take her case into your favorable consideration and allow her such sum as will be sufficient to pay for fencing the road, and compensate for the value of the land actually occupied by said gravelled road and your petitioner as in duty bound will ever pray. Brighton 20th April, 1855 -- Sarah (her mark) Sheaver" (from page 310 or The Tobey Book.
    Note: The petitioner here is Sarah Shearer - not Sheaver - who is the widow of Lewis Shearer, one of the men who died in the Breakeaway of Little Lake in 1852. The location at issue is the land on the east side of the new Brighton-Seymour Gravel Road at the place north of Hilton and south of the steep valley where the Breakaway deluge swept down the creek. Carmen Road runs east on the southern edge of the Shearer land and the road to the Stone School goes east on the north side of the pond where a cheese factory was located during my childhood in the 1950's and 1960's. This petition shows that the new road ran along the west side of the Shearer land and needed a fence to keep common traffic off of their property. This demonstrates that The Brighton and Seymour Gravel was built soon after The Breakaway happened in order to replace The Old Percy Road to the west. It is interesting to note that in 1855 the new Brighton-Seymour Gravel was still seen and spoken of as "the Percy Road" - not the Cambellford Road or the Syemour Road or the Warkworth Road. The village that would later take the name Norham and the growing village at Warkworth was even then called Percy when described in terms of Brighton Township roads.13
